UPON the application made by the Defendant by application notice dated 17 July 2024 for Orders pursuant to CPR r. 39.2 (4) and CPR r.5.4C (4) (c) (the “Confidentiality Application”)

AND UPON the court being referred to the order of Lane J in claim number KB-2023-003029 and the provisions for anonymity and restriction of access to court documents in that order

AND UPON the hearing before District Judge Rippon on 26 February 2025 sitting at the County Court at Central London

AND UPON hearing Dominic Bray of Lee & Thompson LLP, Solicitor for the Defendant and the Claimant representing himself (with assistance from his wife)

IT IS ORDERED THAT:

1. The Court considers that it is necessary pursuant to CPR r. 39.2 (4) that the identities of the parties shall not be disclosed. The Claimant shall be referred to as “B” and the Defendant shall be referred to as “A”.

2. A non-party shall only be permitted to access a copy of any application notice, evidence, or statement of case from the Court file if the names of the parties are redacted and not without further order of the Court in accordance with paragraph 3 below.

3. Any non-party other than a person notified or served with this Order seeking access to, or copies of the above mentioned documents, or any other document filed by a party or communication between the Court and a party, must make an application to the Court, proper notice of which must be given to the solicitors for the Defendant.

4. A copy of this Order shall be published on the website of the Judiciary of England and Wales.

5. The Defendant has permission to rely on the Confidential Schedule to its Amended Defence dated 19 August 2024 and shall file the Confidential Schedule (in anonymised form) with the Court no later than five business days after receipt of a sealed copy of this Order.

6. Any person who is not a party to the proceedings may apply to set aside or vary paragraph 1 of this Order, provided that written notice of such application is given to solicitors for the Defendant within two business days of such application being made. Solicitors for the Defendant shall, in turn, serve such notice of application on the Claimant within two business days of receiving such notice of application.

8. If and to the extent that the Claimant successfully appeals against the High Court Order of the Honourable Mr Justice Lane dated 10 August 2023, and/or the High Court Judgment of Master Yoxall dated 14 June 2024, the Claimant shall be at liberty to apply to set aside or amend the terms of this Order. Any such application must also be served on the Defendant’s solicitors
