UPON READING the Claimant’s Claim Form, Grounds, N463 Consideration, and written evidence in support

IT IS HEREBY ORDERED THAT:

  1. Pursuant to CPR r. 39.2, the identity of the Claimant shall not be disclosed directly or indirectly and this matter shall be known and listed as R (BAC) v Royal Borough of Windsor and Maidenhead until the application for permission is determined. The Court on that occasion shall determine whether it is appropriate for that anonymisation to continue thereafter depending on the outcome of that application.
  2. The Defendant’s acknowledgment of service shall be served within 21 days of the service of the claim form.
  3. Thereafter, the Court shall within 42 days consider the applications for permission and for interim relief.
  4. Costs reserved.

Reasons:

Given the claimant’s apparent age and vulnerability it is appropriate to anonymise his name pending the determination of his application for permission. The decision challenged is dated 28 November 2024 and these proceedings were issued just within the three-month period on 27 February 2025. There was a period of more than a month when, although the claimant was aware of the decision, legal representatives were not instructed and the claimant chose to wait to instruct those presently acting. In these circumstances, it is not appropriate to abridge the time for service of the AOS or to direct the determination of the permission application any earlier.
