Anonymity order

On an application by the Claimant for the appointment of a litigation friend, an anonymity order and for urgent consideration

Following consideration of the documents lodged by the Claimant

ORDER by ROBERT PALMER KC (sitting as a Deputy Judge of the High Court)

1. ASY is appointed as the Claimant’s litigation friend.

2. The identities of the Claimant and his litigation friend shall not be published or reported; they shall be referred to as BAS and ASY respectively.

3. The application for permission to claim judicial review shall be put before a judge for consideration on the papers within 7 days of the Defendant filing her Acknowledgement of Service.

4. Costs in the case.

Reasons

1. I am satisfied that ASY Is an appropriate litigation friend for the Claimant and should be appointed.

2. The Claimant is an 11 year old child whose identity (and any identifying details, including the identity of ASY) should be protected.

3. Although it is not appropriate to curtail the time permitted to the Defendant to file and serve her Acknowledgement of Service and Summary Grounds of Defence, some degree of urgency is justified thereafter, given the apparent uncertainty over the Claimant’s future care arrangements.
