Consent order

UPON the Claimant having issued an application for judicial review, based on breach of the Defendant’s obligations under s 42 of the Children and Families Act 2014 and s 19 of the Education Act 1996.

AND UPON the parties having agreed to the disposal of the claim on the basis set out below

BY CONSENT IT IS ORDERED THAT:

  1. The Claimant shall be known as BON in connection with this claim and the Claimant’s litigation friend shall be known as BKA.
  2. In the event that a non-party makes an application for access to any papers on the court file (including a statement of case) this shall not be determined until 14 days notice has been given to the parties to enable them to make representations in this regard.
  3. The claim for judicial review is withdrawn;
  4. Within 2 weeks of the issue of this order, the Defendant shall issue an amended version of the Claimant’s current EHC Plan naming Blue Skies School in section I.

Costs

5. The Defendant shall pay the Claimant’s costs of the claim, to be assessed if not agreed.
6. The Defendant shall make a payment on account of the Claimant’s costs, within 14 days of being served with his schedule of costs, in the sum of 50% of that schedule.
7. There shall be a detailed assessment of the Claimant’s publicly funded costs.

    Liberty to apply

    8. There shall be liberty to apply for the purposes of securing compliance with paragraphs 2, 3 and 4 above.
