UPON HEARING COUNSEL FOR THE CLAIMANT MR. MICHAEL IVERS KC AND Mr. RAMBY De MELLO AND COUNSEL FOR THE BIRMINGHAM YOUTH JUSTICE SERVICE MR.JAMES ROBOTTOM.

IT IS ORDERED THAT:

  1. Permission to apply for judicial review of the decision of the Honourable Mr Justice Garnham sitting at the Birmingham Crown Court dated 6 November 2024 lifting the reporting restriction of the Claimant’s name in the criminal proceedings is granted.
  2. Permission to adduce the witness statement of Ms Ruth Crisp dated 26 November is granted.
  3. The claim for judicial review is granted and the aforesaid decision of Mr Justice Garnham is quashed.
  4. It is ordered that the application made by PA Media to lift the reporting restriction of the Claimant’s name is refused.
  5. It is therefore ordered that the Claimant’s name shall not be reported in accordance with section 45 of the Youth and Criminal Justice Act 1999 until the Claimant has achieved his 18th birthday.
  6. There shall be no order as to costs save for a detailed assessment of the Claimant’s legally aided costs, should that be necessary.
