Following consideration of the documents lodged by the Claimant

ORDER by the Honourable Mr Justice Sheldon

1. Anonymity: Pursuant to CPR 39.2(4) and/or the Court’s inherent jurisdiction and/or s. 6 of the Human Rights Act 1998:
(i) the Claimant shall be referred to by the cipher BSY, and his wife as CSY and children DSY1 to DSY3 respectively;
(ii) the Claimant’s name and the names of his wife and children shall be withheld from the public; and pursuant to s. 11 of the Contempt of Court Act 1981, there must be no publication of the identity of the Claimant or of any matter likely to lead to his identification as a party to these proceedings in any report of, or otherwise in connection with, these proceedings.

2. Any person wishing to vary or discharge paragraph 1 of this Order must make an application, served on each party.

    Reasons

    1. The Claimant has brought an application for judicial review to challenge a decision under the Afghan Relocation and Assistance Policy scheme. The Secretary of State has agreed to reconsider the decision. The Claimant maintains his application for anonymity. I grant this application as the Claimant raises concerns that his identity could, if disclosed, give rise to risk of serious harm from the Taliban in Afghanistan. Of my own motion, I apply the same approach to his wife and children.
