In the matter of an application for judicial review
25 March 2025
Before:
The Honourable Mr Justice Cavanagh
Between:
The King
on the application of
BTT
-v-
Secretary of State for the Home Department
Order
On an application for interim relief and an application for anonymity
Upon consideration of the documents lodged by the Claimant
ORDER by the Honourable Mr Justice Cavanagh
- Until further order, in these proceedings, the Claimant shall be referred to as “BTT” and his father shall not be referred to by name, and the matter shall be listed as and known as “R (BTT) v Secretary of State for the Home Department”.
2. Again until further order, the publication of any information likely to identify the Claimant or his family, whether directly or indirectly, is prohibited.
3. The Defendant shall provide a written response to the Claimant’s application for interim relief (in the form of a mandatory order to provide him with accommodation within a reasonable distance of his parents’ address in Northolt) by 4pm on Friday 28 March 2025.
4. (Subject to judicial availability, the Claimant’s interim relief application will thereafter be considered by a judge on the papers in the week following (that is, the week commencing Monday 31 March 2025 and ending on Friday 4 April 2025.
5. Costs reserved.
Reasons
- In accordance with the normal practice, as the Claimant is an asylum seeker, his name is anonymised.
2. For the reasons put forward in the application for interim relief, connected with the Claimant’s health and mental state, this application is urgent and so I have imposed a deadline on the Defendant to respond, and have then ordered that the matter should be considered by a judge on the papers within 5 working days.
3. I have not granted the 48-hour deadline that has been sought by the Claimant for the Defendant’s response to the interim relief application, because there is a considerable amount of material that needs to be considered (although most if not all of it has already be brought to the Defendant’s attention). Rather, I have given the Defendant to the end of the week.
Signed: Mr Justice Cavanagh
