Order

On an application by the Claimant for interim relief

Following consideration of the documents lodged by the Claimant

ORDER by the Honourable Mr Justice Sheldon

  1. The Claimant shall be referred to in these proceedings as BTY. Pursuant to CPR 39.2(4), no person is to publish in connection with these proceedings the identity of the Claimant or any information likely to lead to his identification.
  2. The Defendant to file and serve a response to the application for interim relief by 4pm on 16 May 2025.
  3. The Court to consider the application for interim relief on the papers as soon as practicable on or before 21 May 2025.
  4. Costs reserved.
  5. Liberty to either party to apply to vary or set aside the Order on 48 hours’ notice to the other party.

Reasons

  1. The Claimant is an asylum seeker from Vietnam. He is currently in immigration detention. The Claimant appears to be a vulnerable person and has expressed suicidal ideation. There is no particular reason why his identity should be public knowledge. In the circumstances, there should be a derogation from the open justice principle and anonymity should be provided to the Claimant. If the Defendant takes the view that anonymity is not required, then she may apply to set aside that order.
  2. The Claimant raises an issue as to the lawfulness of his immigration detention. He is deemed to be an Adult at Risk; there is a suggestion that he has suffered from torture. There is a possibility of a release address with a friend.
  3. There is some urgency to this matter. Accordingly, I direct the Defendant to respond to the application for interim relief this week, so that the matter can be considered on the papers early next week.
