Notification of the Judge’s decision on the application for permission to apply for judicial review (CPR 54.11, 54.12)

Following the Claimant’s applications for judicial review and urgent consideration of the documents lodged by the Claimant

ORDER by the Honourable Mrs Justice Lieven

  1. Pursuant to CPR r.39.2, the identity of the Claimant shall not be directly or indirectly disclosed. These proceedings shall be known as ‘R (BUT by his mother and litigation friend, BSE) v The Independent Review Panel of the London Borough of Lambeth, the Governing Body of A School, and the London Borough of Lambeth.
  2. BSE is appointed as the Claimant’s litigation friend.
  3. The claim is suitable for a substantial degree of expedition.
  4. The Defendant’s Acknowledgement of Service (CPR 54.8) must be filed and served by 4pm on 13 August.
  5. Any Reply from the Claimant (CPR 54.8A) must be filed and served by 4pm 5 days after the Acknowledgement of Service is filed and served.
  6. The papers are to be referred to a Judge or Deputy Judge for a decision whether to grant permission to apply for judicial review or order a rolled-up hearing immediately thereafter.
  7. The parties shall have liberty to apply to vary or set aside this order on 2 working days’ notice to the other parties.
  8. Costs reserved.
