Order

On an application by the Claimant for anonymity and expedition
Following consideration of the documents lodged by the Claimant
ORDER by the Honourable Mr Justice Swift

  1. The Claimant shall be referred to in these proceedings as “BYK”, and pursuant to CPR 39.2 there shall be no publication of the name or address of the Claimant, his wives or their children or any particulars of the case likely to lead to the identification of any of the Claimant, or his wives or their children, without the leave of the court. Any person has liberty on three days’ written notice to the parties to apply to vary or discharge this order.
  2. The application for permission to apply for judicial review will be considered in accordance with CPR 54.10 and 54.12 with 14 days of (a) the date on which the Defendants file and serve Acknowledgments of Service pursuant to CPR 54.8; or (b) the date on which such Acknowledgments of Service ought to have been filed and served in accordance with CPR 54.8, whichever is the sooner.

Reasons

  1. Having regard to the information in the Claim Form I am satisfied that an order for anonymity should be made. Any person may apply, on notice, to vary or set aside the order.
  2. The Claimant’s request for a modest degree of expedition is also appropriate given that he and his family remain in Afghanistan.
