UPON the Court having made, on 2 May 2025, directions for anonymity and associated restrictions on open justice in these proceedings
AND UPON considering the Interested Parties’ application for further directions dated 21 August 2025
AND PURSUANT TO s 11 of the Contempt of Court Act 1981; CPR 5.4C and 39.2(4); and the Court’s inherent jurisdiction, the Judge being satisfied that it is necessary to secure the proper administration of justice
IT IS ORDERED THAT:
- The Interested Parties’ aunts and uncle (as identified in the Interested Parties’ application notice) are granted anonymity and are to be referred to for all purposes in these proceedings as OP, QR, ST, and UV.
- Until further order:
2.1. Nothing shall be published which may directly or indirectly identify the Interested Parties’ aunts or uncle in connection with these proceedings.
2.2. Any information or evidence in these proceedings which concerns the treatment of detainees by camp authorities, as further specified in the Confidential Schedule to this order, shall be withheld from the public and there shall be no report or publication thereof. For the avoidance of doubt, this paragraph does not prevent reporting on or publication of evidence based on material in the public domain. - So far as any document to which a non-party may have access pursuant to CPR 5.4 or 5.4C does not comply with paragraph 1 above, the Interested Parties’ solicitors have leave to file with the Court copies of such documents adjusted so as to comply. Such copies are to be treated for all purposes as being in substitution for the relevant originals. A non- party may not obtain a copy of any document from the court file unless it has been anonymised in accordance with paragraph 1.
- Pursuant to CPR 5.4C(4)(d), any application by a non-party for access to the following documents must be made on 7 days’ notice to the parties (in particular with a view to affording the parties an opportunity to make submissions as to any redactions they consider to be necessary and appropriate), and no copy of these documents is to be provided to a non-party unless they have been redacted in accordance with paras 1 and 2 above:
4.1. CONFIDENTIAL Witness Statement of YZ dated 21 August 2025;
4.2. CONFIDENTIAL Witness Statement of AB dated 21 August 2025;
4.3. Summary Expert Report of Dr Amy Cohen dated 14 July 2025; and
4.4. Addendum Expert Report of Dr Amy Cohen dated 21 August 2025. - Any interested party, whether or not a party to these proceedings, may apply to the Court to vary or discharge the orders in paragraphs 1-4 above, provided that any such application is made on 7 days’ notice to the parties.
- Pursuant to CPR 39.2(5), a copy of this order, excluding its Confidential Schedule, shall be published on the website of the Judiciary of England and Wales.
- Costs in the case.
