UPON the Claimant having issued his claim on 3 May 2024 and filing an amended claim on 12 June 2024;

AND UPON the Defendant having filed its Acknowledgment of Service and Summary Grounds of Resistance on 17 September 2024 following several agreed stays;

AND UPON the Claimant having filed his Reply on 19 September 2024;

AND UPON the Claimant receiving confirmation on 27 September 2024 that the personal budget had been approved by the local authority, and receiving confirmation on 28 September 2024 that the outstanding invoices relating to past provision had been paid;

AND UPON the parties agreeing that the issues in this claim are now settled;

AND UPON the Court considering the Claimant’s application for approval of the settlement of this claim, in accordance with CPR r 21.10;

IT IS ORDERED that

  1. The Claimant is granted anonymity and is to be referred to as ‘CA’

2. The consent of the Interested Party is dispensed with

AND BY CONSENT it is ordered that

  1. The Claimant has permission to withdraw his claim for judicial review;
  2. The Defendant do pay the Claimant’s reasonable costs, to be assessed if not agreed;
  3. The Claimant’s legal aid costs to be subject to detailed assessment;
  4. The settlement of the claim embodied in this order is approved by the Court, in accordance
    with CPR r 21.10.
