Note and sentence

At a hearing in open court at the Mansfield County Court on the 16 April 2026 before District Judge Wall the defendant , Martin Heath, was brought before the Judge for 3 breaches of the injunction granted on the 31 July 2025 in this matter, having been arrested yesterday.

The Court has considered the file and the witness statement of PC Allan dated 15 April 2026 and was satisfied the reference to the 14 April was a typographical error and it should have read 15 April and that accordingly the defendant had been brought before the Court within the 24 hour time frame permitted. That was accepted by the defendant.

And upon the defendant being represented by the duty solicitor and having heard submissions from both parties legal advocates, including the admission as to the breaches the Court confirmed it was satisfied to the criminal standard that the defendant had breached the orders by being in an exclusion zone, on the 11 April 2026 and twice on the 14 April 2026, the court went on to sentence the Defendant to 3 months imprisonment and, to activate the suspended order made in September 2025 in this matter being 1 month to run concurrently, so the total sentence is 3 months.
