In relation to the above numbered case on 6 October 2021 District Judge Brown sitting in the County Court in Bath, sentenced the defendant in that case, to a custodial sentence of 2 months, suspended for a period of 12 months for breach of an injunction order dated 9 October 2020 and breach of bail conditions imposed by order dated 10 September 2021.
The basis of the sentence imposed is that Ian Baker was in breach of the injunction by posting plant material through his neighbour’s letter box, being verbally aggressive towards that neighbour, causing damage to his property and being violent by way of pushing and punching on 9 September 2021. Ian Baker breached the bail condition not to return to his property before 16 September 2021 as set out in the court order dated 10 September 2021.
The breaches on 9 September 2021 were contrary to the terms of the injunction Order dated 9 October 2020 to which Ian Baker was subject. The breach of bail conditions was contrary to the order of 10 September 2021.
