Summary of Decision in Committal Proceedings
Following a trial at which the Defendant failed to attend the Defendant was held to have been in contempt of court following two breaches of an Antisocial Behaviour Injunction Order dated 28 June 2021. The Defendant had been arrested on 16 July 2021 for breaching the terms of the order and then arrested again on 20 July 2021 for breaching the terms of the order. Having considered the evidence the Defendant’s breaches were considered serious and persistent, and such as to cause significant cause harm to others. These breaches represented the second and third breaches of the injunction order within a short period of time and at least one of the breaches involved racially aggravating factors. The custody threshold was considered to have been met. The court took into account the Defendant’s mental health conditions and imposed 16 weeks sentences of imprisonment for each breach to run concurrently, suspended for 12 months upon the Defendant complying with the terms of the Antisocial Behaviour Injunction Order dated 28 June 2021 as amended. The Defendant was ordered to pay costs.
