Case number: F02MA425

Party details: Stonewater Ltd v Amanda Miles

Name of person: Amanda Miles

Nature of the contempt of court:

On 25 June 2019, an order was made at the County Court at Warwick, under Anti-social Behaviour, Crime and Policing Act 2014, prohibiting the Respondent from engaging in, or threatening to engage in, conduct capable of causing a nuisance or annoyance to any person who resides in, visits or engages in a lawful activity in the neighbourhood of Claypitts Boulevard, Warwick CV34 6HQ.

By a contempt application made on 12 January 2021, the Applicant alleged that the Respondent had breached this order in that on 28 December 2020 from 11pm to around 2:30am on 29 December 2020, the Respondent was arguing, banging, smashing her partner’s car with a bottle, and swearing.

The Respondent, who was legally represented, admitted having breached the injunction order by her conduct in the street between 01:30 and 02:00 on 29 December 2020.

The court therefore found that the Respondent had engaged in conduct capable of causing a nuisance or annoyance to any person who resides in, visits or engages in a lawful activity in the neighbourhood of Claypitts Boulevard, Warwick CV34 6HQ.

The court considered CPR PD2B; CPR 81; Solihull MBC v Willoughby [2013] EWCA Civ 699; Haringey LBC v Brown [2015] EWCA Civ 483; In re O (Committal: Legal Representation) [2019] EWCA Civ 1721; Corrigan v Chelsea Football Club [2019] EWCA Civ 1964; The All England Lawn Tennis Club (Championships) Ltd v McKay [2019] EWHC 3065 (QB); Sentencing Council Breach offences: Definitive Guideline; and, Civil Justice Council Anti-social Behaviour and the Civil Courts.
