In relation to the above numbered case on 6 October 2021, District Judge Naidoo sitting in the County Court at Clerkenwell & Shoreditch as a District Judge of the County Court, sentenced the Defendant in that case ALAN JAYES, to a custodial sentence of 4 months for contempt of court on breach of an Injunction Order dated 6 November 2020. The basis of the sentence imposed is that ALAN JAYES was in breach of the Injunction dated 6 November 2020, by
- On 16th to 17th May 2021 by singing and playing loud music between the hours of 23:30 and 08:00 in such a way as to be audible outside of his premises causing a nuisance and annoyance to persons in the locality of 16 Emberton Court in breach of paragraph 1 of the Injunction Order.
- On 17th May 2021 playing loud music and shouting in the early hours of the morning in such a way as to be audible outside of his premises causing a nuisance and annoyance to persons in the locality of 16 Emberton Court in breach of paragraph 1 of the Injunction Order.
- On 18th May 2021 between 02:37 and 23:23 playing loud music and shouting in the early hours of the morning in such a way as to be audible outside or his premises causing a nuisance and annoyance to persons in the locality of 16 Emberton Court in breach of paragraph 1 of the Injunction Order.
- On 19th to 20th May 2021 between 22:00 and 08:30 playing loud music in such a way as to be audible outside of his premises causing a nuisance and annoyance to persons in the locality of 16 Emberton Court in breach of paragraph 1 of the Injunction Order.
These breaches were contrary to the terms of the Injunction Order dated 6 November 2020 to which the Defendant ALAN JAYES was subject.
