Pursuant to paragraph 13 of Practice Direction: Committal for Contempt of Court – Open Court dated 26 March 2015
In relation to claim no. BR-2020-000333, on 23 April 2021 at the Royal Courts of Justice in London, Mr Justice Morgan sentenced Errol Anthony Lueshing (aka Errol Luesing) to 10 months imprisonment for contempt of Court.
The basis of the sentence was that Errol Anthony Lueshing (aka Errol Luesing) committed a total of 6 breaches of an order made on 27 May 2020 by Insolvency and Companies Court Judge Jones in particular paragraphs 6, 7(i), 7(iii), 10, 11 and 12 of that order
These paragraphs required:
Paragraph 6
Not to interfere with the statutory duties or functions of his trustees in bankruptcy or the management of his bankruptcy estate
Errol Anthony Lueshing (aka Errol Luesing) breached this paragraph by interfering with the duties and functions of his trustees in bankruptcy and the management of his bankruptcy estate by collecting and attempting to collect rents and contacting tenants
Paragraph 7 (i)
Not to collect or attempt to collect any rents payable for any of the properties set out in Schedule 1 to the order
Errol Anthony Lueshing (aka Errol Luesing) breached this paragraph by collecting and attempting to collect rents payable for the specified properties
Paragraph 7 (iii)
Not to seek to contact all or any of the tenants of the properties set out in Schedule 1 to the order
Errol Anthony Lueshing (aka Errol Luesing) breached this paragraph by contacting tenants of the specified properties
Paragraph 10
To transfer to the trustees in bankruptcy all deposits and rents for any of the properties in the bankruptcy estate
Errol Anthony Lueshing (aka Errol Luesing) breached this paragraph by failing to transfer the deposits and rents as required
Paragraph 11
To serve a witness statement containing specified information and exhibiting specified documents
Errol Anthony Lueshing (aka Errol Luesing) breached this paragraph by failing to deliver a witness statement as required
Paragraph 12
To deliver to the trustees in bankruptcy specified documents
Errol Anthony Lueshing (aka Errol Luesing) breached this paragraph by failing to deliver the documents as required
The court found that the six counts of breach were proved
The Court imposed a sentence of 10 months imprisonment in respect of the breaches of the order
If Errol Lueshing (aka Errol Luesing) has satisfied the court that he/she has purged his/her contempt of Court, the Court will consider, in the light of any apology afforded, whether to remit the whole or any part of the sentence imposed on them.
