  1. On 11 October 2021, Richard Rothschild was found in contempt of court for 6 breaches of orders:
  • Contrary to an order made on 5 February 2020 he failed to provide to the applicant all keys held in respect of 43 and 44 Greystoke House within 7 days of the date of the order;
  • Contrary to an order made on 5 February 2020 he failed immediately to give notice to the current occupiers of 43 and 44 Greystoke House to vacate, and failed to require them to agree to an immediate surrender of the tenancies and ensure vacant possession by no later than 12 March 2020;
  • Contrary to an order made on 7 July 2021, he failed to sign and validly execute two documents being a Power of Attorney and a letter of authority in favour of the applicant;
  • Contrary to an order made on 7 July 2021, he failed to send the originals of the validly executed documents to the applicant’s solicitors;
  • Contrary to an order made on 7 July 2021, he failed to attend in person the hearing on 27 July 2021;
  • Contrary to an order made on 27 July 2021, he failed to file and serve documentary evidence of all his best endeavours to procure the release of the applicant from the mortgage secured against 45 Addison Gardens in the name of the applicant and Mr Rothschild’s mother in accordance with his obligation under paragraph 44 of the order of 5 February 2020 by 4pm on 31 August 2021.

 

2) Richard Rothschild was sentenced as follows:

  • For the breaches at 1(i) and (ii) above, to 28 days of imprisonment, suspended for 28 days upon compliance with the original orders, to run concurrently with each other and consecutively to the sanctions imposed for the breaches at 1(iii)-(vi)
  • For the breaches at 1(iii) and (iv) above, to 28 days of imprisonment, suspended for 14 days upon compliance with the original orders, to run concurrently with each other and consecutively to the sanctions imposed for the breaches at 1(i)-(ii) and 1(v-vi)
  • For the breach at 1(v) above, no sanction was imposed
  • For the breach at 1(vi) above, to 28 days of imprisonment, suspended for 14 days upon compliance with the original order, to run consecutively to the sanctions imposed for the breaches at 1(i)-(v)

 

3) On 11 October 2021, Wanda Radziszewska was found in contempt of court for 2 breaches of orders:

  • Contrary to an order made on 7 July 2021, she failed to sign and validly execute a Power of Attorney in favour of the applicant;
  • Contrary to an order made on 7 July 2021, she failed to send the original of the validly executed document to the applicant’s solicitors.

 

4) Wanda Radziszewska was sentenced to 28 days imprisonment for each breach, suspended for 14 days on compliance with the original orders, to run concurrently with each other.
