In relation to F52YJ857 on the 4th November 2024, sitting at Bolton Crown Court, The Law Courts, Blackhorse Street, Bolton BL1 1SU for the County Court at Manchester, 1 Bridge Street West, Manchester, M60 9DJ, before His Honour Judge Khan, sentenced –

Muhammed Pervaiz to an immediate custodial sentence of 18 weeks for contempt of Court.

Mohammed Altaf to an immediate custodial sentence of 26 weeks for contempt of Court.

Muhammed Zaheer to an immediate custodial sentence of 8 weeks for contempt of Court.

Mohammed Yaqub to an immediate custodial sentence of 6 weeks for contempt of Court.

The basis of that sentence was that:-

  1. Mr Pervaiz had brought a claim against Mrs Duong for damages for personal injury and vehicle related losses caused by her negligent driving in an accident on 7 November 2018;
  2. Mr Pervaiz, Mr Altaf, and the passengers in Mr Pervaiz’s car, Mr Rasool, Mr Zaheer and Mr Yaqub had made written statements in support of Mr Pervaiz’s claim;
  3. On the 27 October 2021 District Judge Haisley dismissed Mr Pervaiz’s claim and found the claim to be fundamentally dishonest;
  4. On 19 December 2022, Mrs Duong issued a contempt application against the Respondents;
  5. On 8 August 2024, His Honour Judge Khan:-

    • 5.1. Dismissed the application against Mr Rasool;

    • 5.2. Found that Mr Pervaiz, Mr Altaf, Mr Zaheer and Mr Yaqub had conspired to stage the accident;

    • 5.3. Found that Mr Pervaiz, Mr Zaheer and Mr Yaqub had given false evidence orally and in writing;

    • 5.4. Found that Mr Altaf had attempted to coach Mr Zaheer during the course of MrZaheer’s cross-examination;

    • 5.5. Found that as a consequence Mr Pervaiz, Mr Altaf, Mr Zaheer and Mr Yaqub had interfered with the due administration of justice.
