Order

At a hearing in open court at the County Court sitting in Mansfield on 26 June 2026 Before District Judge Wall

And upon hearing a solicitor for the claimant and the defendant not attending

And upon this being an application for committal it being alleged that the defendant has breached an antisocial behaviour injunction dated 4 September 2025 on 13 occasions since it was made

And upon noting that the defendant was in Prison and arrangements had been made to enable him to attend at this committal hearing by video link but that the defendant declined to attend notwithstanding he was made aware (by the prison staff at the request of the Judge as well as in the papers served on him as noted below ) that the court would proceed in his absence

And upon the Judge being satisfied to the criminal standard that:

(a) that the defendant had been personally served with the anti-social behaviour injunction made on the 4 September 2025,

(b) and that he had also been personally served with this committal application and that committal application sent out the defendant’s rights (including but not limited to a right to be silent and to have a solicitor as well as warning the defendant that an order could be made in his absence)

(c ) and that he had been given an opportunity to attend by video link but had declined to do so

And upon the solicitor for the claimant confirming that allegation 10 in the schedule of allegations relied upon was withdrawn as it was hearsay

And upon the Judge being satisfied to the criminal standard that there had been 12 breaches of the Injunction made in this matter on the 4 September 2025 being primarily loitering in a restricted area contrary to paragraph 1e of that injunction of the 4 September 2025 and on one occasion also swearing contrary to paragraph 1b of that injunction of the 4 September 2025

Having reviewed matters and considered the guidance on Lovett v Wigan CC [2022] EWCA Civ 1631the court determined that the appropriate sentence in this matter was that the defendant be sent to prison for 2 months but that this committal order is suspended until 25 June 2027 on condition that the defendant do comply with the terms of the injunction made in this matter on the 4 September 2025.

IT IS ORDERED THAT:

(1) the defendant ,Mark Quimby, be sent to prison for 2 months but that this committal order is suspended until 25 June 2027 on condition that the defendant do comply with the terms of the injunction made in this matter on the 4 September 2025

(2) the defendant shall pay the claimants costs limited to the issue fee of £313 by 4pm 3 August 2026
