Before Deputy District Judge Stafford sitting at the County Court at West Cumbria, West Cumbria Court House, Hall Park, Ramsay Brow, Workington, Cumbria, CA14 4AS on 08 September 2025

UPON hearing from Mr Jones, Counsel for the Applicant (via CVP), and Mr Frazer, Solicitor Advocate for the Respondent (via CVP);

AND UPON the Court considering the Applicant’s committal application dated 29 August 2025, which arises out of events which occurred on 19 June 2025.

AND UPON the Claimant consenting and the Court permitting service of the application via Mr Frazer (CPR 81.5), and Mr Frazer having had sufficient time to take instructions.

AND UPON the Court recording that since the making of that application on 29 August 2025 the Respondent has been sentenced to a 16-month custodial sentence by the Crown Court in relation to the same factual events (19 June 2025) which formed the basis of the committal application dated 29 August 2025

AND UPON the Respondent admitting the the breaches contained in the application dated 29 August 2025 which are in any event proven by virtue of the Respondent’s conviction (section 11, Civil Evidence Act 1968);

AND UPON the Court recording that the Respondent has not yet been sentenced for the breaches committed on 25 December 2024, but the Court having given an indication at a hearing on 3 March 2025 that a sentence of 28 days’ imprisonment would have been imposed, as recorded in the order of Deputy District Judge Ikram

IT IS ORDERED THAT

1) The Applicant’s application dated 29 August 2025 succeeds; however, in light of the custodial sentence imposed by the Crown Court no further sentence is passed in respect of the breaches arising out of the events dated 19 June 2025.

2) The Respondent is sentenced to 28 days imprisonment in relation to the breaches committed on 25 December 2024, said period being consecutive to any other term of imprisonment.

3) The Respondent shall pay the Applicant’s costs relating to the four admitted breaches on 25 December 2024 and breaches arising out of the events on the 19 June 2025. The Applicant’s costs are summarily assessed in the sum of £3,341.
