Order

BEFORE HHJ Robinson BEM, sitting in the County Court at Middlesbrough, Teesside Combined Court Centre, Middlesbrough, TS1 2AE on 23rd June 2026.

A. UPON the committal application for breach of an injunction made pursuant to s.1 of the Anti-Social Behaviour, Crime and Policing Act 2014 coming on for hearing;

B. UPON the Court hearing from Mr Ross, counsel for the Claimant, and from Mr Deadman, solicitor for the Defendant;

C. UPON the Court recording that the Defendant confirmed that he had erroneously attended Court today rather than yesterday, when the case had been listed. An arrest warrant had been issued yesterday and the Defendant duly surrendered today;

D. UPON the Court having made the following findings yesterday:

a. On 3 March 2026 the defendant attended the 10th floor of Hume House, in breach of the said Injunction.

b. On 1 April 2026 the defendant attended the 15th floor of Hume House, and was smoking when doing so, in breach of the said Injunction.

c. On 20 April 2026, the defendant attended the 7th floor of Hume House, in breach of the said Injunction.

d. On 15 May 2026, the defendant was laid on the floor of Hume House and appeared intoxicated, which caused a nuisance to other residents who needed to physically step over him, in breach of the said Injunction.

E. UPON the Court recording the Claimant confirmed that, following all four breaches being proven in the Defendant’s absence yesterday, it invited the court to sentence forthwith. The Claimant also asked that the injunction be amended to prohibit attendance at all parts of Nolan House and Hume House, and to attach a Power of Arrest.

F. UPON the Court recording that the Defendant confirmed that he accepted the breaches proved against him, and did not oppose the application to extend the exclusion area and attach a Power of Arrest.

G. UPON the Court proceeding to sentence today.

IT IS ORDERED THAT:

  1. The Defendant was sentenced for contempt as follows:
    a. 7 days custody for each of the four breaches – a global total of 28 days custody.
    b. All 28 days custody to be suspended on terms that the Defendant complies with the injunction order for its remaining duration.
    c. The injunction order is today extended until 23.59 hours on 23.6.2027; for the avoidance of doubt the sentence is 28 days custody suspended until 23.59 hours on 23.6.2027.
  2. The injunction order of District Judge Cook dated 14.6.2024 is amended as follows:
    A. Shaun Walsh is forbidden from: at any time or any place engaging in conduct which is capable of causing nuisance or annoyance (including but not limited to harassing or threatening, intimidating, or seeking to intimidate, using or threatening violence) to any member of the public, Thirteen Housing Group Limited Staff or Representative of Thirteen Housing Group Limited)” and
    B. Entering any part of Nolan House and Hume House, Stockton-on-Tees – as set out in the map annexed hereto this order.
    C. A Power of Arrest is attached to paragraph A. of this injunction pursuant to s.4 Anti-Social Behaviour, Crime and Policing Act 2014; a constable may arrest without a warrant if the constable has reasonable cause to suspect that Shaun Walsh is in breach of paragraph A.
    D. The injunction remains in force until 23.59 hours on 23.6.2027.
  3. No Order as to costs, save for legal aid assessment of any publicly-funded party.
