Committal for Contempt of Court

  1. This is a committal hearing in respect of 5 alleged breaches by Shunte Evans of a number of court orders made within linked private law proceedings. The breaches are as follows:

    (i) Failing to attend a hearing on 14th July 2023 having been ordered to do so by the Lay Justices on 24th May 2023 with a penal notice attached.

    (ii) Failing to make sure that the child of the family attended contact with his mother on 27th July 2023 and 10th August 2023 having been ordered to do so by Deputy District Judge Cooper on 14th July 2023 with a penal notice attached.

    (iii) Failing to attend a hearing on 21st September 2023 having been ordered to do so 2nd August 2023 by District Judge McIlwaine with a penal notice attached.

    (iv) Failing to make sure that the child of the family attended contact with his mother on 28th September 2023 and 7th October 2023 having been ordered to do so by District Judge Armitage on 21st September 2023 with a penal notice attached.

    (v) Failing to make sure that the child of the family attended contact with his mother on 26th October 2023 and 4th November 2023 having been ordered to do so by District Judge Armitage on 18th October 2023 with a penal notice attached.
  2. Ms York made an application to commit Mr Evans dated 31st October 2023 and the matter was listed before me today. Both parties were represented by Counsel.
  3. Mr Evans admitted each of the breaches and the court heard submissions from his Counsel in mitigation.
  4. The court sentenced Shunte Evans to a committal order of 14 days for contempt of court in respect of each of the breaches, to run concurrently. The court suspended the sentence until 11.59pm on 16th July 2024, not to be enforced if during that time Shunte Evans complies with the terms of all future court orders which will have penal notices attached.
