Order

On an urgent application by the Claimant for an directions order

UPON consideration of the documents lodged by the Claimant in support of its application for urgent consideration (Form N463)

AND UPON the Court being satisfied that the directions contained in this order are necessary to secure the proper administration of justice

ORDER by the Honourable Mr Justice Murray

  1. Pursuant to CPR, r.3.1(2)(a), the time limit under CPR, r.54.7(b) for serving the Claim Form on the Interested Parties is extended such that it shall expire 7 days after the determination of the Claimant’s application made in section 9.1 of the Claim Form for a direction that service of the Claim upon the Interested Parties be dispensed with.
  2. Pursuant to CPR, r.39.2(4), the name of the 3rd Interested Party (that is the person listed in the Confidential Schedule to the Claim Form) shall not be disclosed in any proceedings in open court. The 3rd Interested Party shall be described “Mr X” in all statements of case, orders and judgments of the Court.
  3. Pursuant to CPR, rr.5.4B(1) and 5.4C(4), no person (other than the Claimant or the Defendant) may obtain from records of the Court a copy of the Confidential Schedule to the Claim Form.
  4. The Claimant shall serve a copy of this Order on the 1st and 2nd Interested Parties.
  5. Any person wishing to apply to vary or discharge this Order must make an application to the Court on notice to the Claimant and the Defendant.
  6. Pursuant to CPR, r.39.2(5), a copy of this Order shall be published on the website of the Judiciary of England and Wales (www.judiciary.uk). Any person who is not a party to the proceedings may apply to attend the hearing and make submissions, or apply to set aside or vary the order.
