Order

On an application by the Claimant for urgent consideration, interim relief and directions

Following consideration of the documents lodged by the Claimant

ORDER by the Hon. Mr Justice Mould:

  1. Anonymity:
    (a) Under the Court’s inherent jurisdiction and pursuant to CPR39.2(4) and s. 6 of the Human Rights Act 1998:
    (i) the Claimant’s name is to be withheld from the public and must not be disclosed in any proceedings in public; and
    (ii) the Claimant is to be referred to orally and in writing as “CPK”.
    (b) Pursuant to s. 11 of the Contempt of Court Act 1981, there must be no publication of the identity of the Claimant or of any matter likely to lead to the identification of the Claimant in any report of, or otherwise in connection with, these proceedings.
    (c) Pursuant to CPR 5.4C(4):
    (i) the Claimant’s solicitors must within 7 days file and serve a redacted copy of any statement of case already filed, omitting the name, address and any other information likely to lead to the identification of the Claimant;
    (ii) if any statement of case subsequently filed includes information likely to lead to the identification of the Claimant, a redacted copy omitting that information must be filed at the same time and must then be served with the unredacted version;
    (iii) unless the Court grants permission under CPR 5.4C(6), no non-party many obtain a copy of any unredacted statement of case.
    (d) Any person wishing to vary or discharge this Order must make an application, served on each party.
  2. Mandatory injunction:
    (a) By no later than 4pm on 28 August 2025, the Second Defendant must provide or secure the provision to the Claimant of accommodation approved by his probation officer as suitable for his release in accordance with the conditions of bail granted by the Upper Tribunal on 4 June 2025 (and subsequently renewed).
    (b) The Second Defendant may apply on 48 hours’ notice to vary or discharge paragraph 2(a) above, any such application to be served on the other parties to this claim.
  3. Costs reserved

Reasons

Anonymity: The evidence before the court establishes that the Claimant is a vulnerable individual in serious physical and mental ill health currently detained under immigration powers and awaiting a decision whether he is to be deported from the United Kingdom. In my view, his circumstances at the present time do provide a convincing justification for granting him limited anonymity in these proceedings. There are accordingly compelling reasons for the limited derogations from the principle of open justice in paragraph 1.

Mandatory injunction: The grounds of this proposed claim raise a serious issue to be tried. I am satisfied that the evidence provided in support of the claim and this urgent application demonstrates a strong prima facie case justifying the grant of the mandatory order sought against the Second Defendant. The Claimant is an adult at risk who has been in detention since 11 March 2025. Since 4 June 2025 he has been in receipt of the grant of bail subject to the condition that he reside at premises provided and approved by his probation officer. The commencement of his bail is dependent on that condition being fulfilled. Bail has since been renewed subject to the same condition on 2 July 2025 and 30 July 2025. Urgent inquiries and requests for progress reports made on his behalf since that date have not resulted in any clear timescale within which this adult at risk may expect to be released from detention in accordance with the conditions of his bail. The urgent interim order sought on his behalf is clearly justified for the reasons stated in the application.
