On an application by the Claimant for urgent reconsideration of his application for anonymity

Following consideration of the documents lodged by the Claimant

ORDER BY RICHARD WRIGHT KC SITTING AS A DEPUTY HIGH COURT JUDGE

  1. Anonymity:

(a) Pursuant to CPR 39.2(4) and/or the Court’s inherent jurisdiction and/or s. 6 of the Human Rights Act 1998:

(i) the Claimant’s name is to be withheld from the public and must not be disclosed in any proceedings in public; and

(ii) the Claimant is to be referred to orally and in writing as DD.

(b) Pursuant to s. 11 of the Contempt of Court Act 1981, there must be no publication of the identity of the Claimant or of any matter likely to lead to the identification of the Claimant in any report of, or otherwise in connection with, these proceedings.

(b) Any person wishing to vary or discharge this Order must make an application, served on each party.

(c) This order will be reviewed at the hearing listed before me on Wednesday 3rd June 2026.

REASONS

(1) Anonymity: Whilst I find many aspects of the Claimant’s application for anonymity difficult to follow, I note that in earlier proceedings Sheldon J was persuaded to grant anonymity on the basis that the Claimant’s children might be identified. I do not accept the Claimant’s argument that the order of Sheldon J means that anonymity must follow as of right in these quite separate proceedings, nor do I accept that there has been any breach of the earlier order of Sheldon J by the Court not making an anonymity order in this case. However, the case is listed before me in three days’ time and it seems to me that for the sake of three days it is appropriate to make an anonymity order that can be reviewed at that hearing. The Claimant will need to establish on 3rd June why it is that an ongoing derogation from the principle of open justice should be made.
