Order

On an application by Claimant for the relief set out in their application (N463) dated 31 October 2022

Following consideration of the documents lodged by the Claimant

ORDER by His Honour Judge Mithani KC sitting as a Judge of the High Court:

1 The time for the Defendant to file their acknowledgment of service and summary grounds of resistance are abridged to 14 days from the date of service of this order upon the Defendant.

2 Until further order, the Claimant is granted anonymity. The Claimant’s identity is anonymised, prohibiting publication of any details which may lead to their identification. The claim shall be known and listed as DK v Sandwell Metropolitan Borough Council.

3 The application for permission shall be considered on paper upon the filing by the Defendants of their Acknowledgments of Service or (if earlier) after the expiry of the period for doing so.

4 Any party affected by this order may apply to vary or set it aside no later than 2 clear days of the receipt of the order by that party.

5 Costs reserved.

Reasons

Given what is said in the application for expedition, there is good reason to abridge time for the filing of acknowledgments of service to 14 days as requested by the Claimant.
