UPON the Claimant’s application for interim relief in the form of an order requiring the Defendant to make a decision on the Claimant’s application for asylum support under s4 Immigration and Asylum Act 1999 (“IAA”) having been granted by Order of Mr Justice Jay dated 2 November 2021
AND UPON the Defendant having positively determined the Claimant’s application for s4 IAA support
AND UPON the Defendant having accommodated the Claimant under s4 IAA in the London area
AND UPON non-disclosure of the identity of the Claimant being necessary in order to protect the interest of the Claimant, pursuant to rule 39.2(4) of the Civil Procedure Rules
AND UPON the parties having agreed to compromise the substantive judicial review claim
BY CONSENT IT IS ORDERED THAT:-
1. The Claimant withdraws the claim no CO/3737/2021
2. The Claimant’s claim shall be anonymised and shall be referred to in these proceedings as DK
3. The Defendant shall pay the Claimant’s inter partes costs of the claim, to be assessed if not agreed.
4. The Defendant shall pay £1,500 of the Claimant’s inter partes costs of the claim (on account) within 28 days of receipt of the final bill from the Claimant.
5. There shall be a detailed assessment of the Claimant’s publicly funded costs.
