UPON the Appellant applying for and being granted permission by the Honourable Lord Justice Singh to appeal the Orders of the Honourable Mr Justice Sheldon dated 31 July 2025 and 14 August 2025 to the extent set out in the Appellant’s grounds of appeal of 28 August 2025.
AND UPON the Honourable Mr Justice Garnham having made Orders in respect of anonymity, access by third parties to the court file and reporting restrictions following a preliminary hearing on 28 March 2025.
AND UPON Honourable Mr Justice Johnson having continued those Orders following a pre-trial review on 26 June 2025.
AND UPON consideration of the lifelong Reporting Restriction Order of the Honourable Mr Justice Goss made on 7 October 2022 sitting in the Manchester Crown Court made pursuant to section 46 Youth Justice and Criminal Evidence Act 1999 and varied by the Honourable Mr Justice Goss on 3 September 2024 pursuant to section 46(9) Youth Justice and Criminal Evidence Act 1999
AND UPON there having been no subsequent variation of the same.
AND UPON the Respondent having made an application in his Respondent’s Notice for the Orders of the Honourable Mr Justice Garnham to be continued mutatis mutandis in respect of the Appellant’s appeal to the Court of Appeal.
IT IS HEREBY ORDERED, pursuant to section 11 of the Contempt of Court Act 1981, section 37 of the Senior Courts Act 1981, sections 6 and 8 of the Human Rights Act 1998 and CPR Rules 5.4C to 5.4D and CPR Rule 16 and CPR Rule 39.2, and in addition pursuant to the Court’s inherent jurisdiction, THAT:
- The Orders of the Honourable Mr Justice Garnham made following a preliminary hearing on 28 March 2025 in respect of anonymity, access to the court file and reporting restrictions, are to be continued and apply mutatis
mutandis to the Appellant’s appeal to the Court of Appeal, the hearing of the same and all steps taken in respect of the same. - A copy of this Order shall be published on the Judicial Website of the Court of Appeal specifying that the Appellant shall be referred to as NHS Foundation Trust L and the Respondent as Dr MN.
- Any non-party affected by this Order may apply on notice to all parties to have this Order set aside or varied.
- Costs in the case.
