Order
On an application by the Claimant for (a) an anonymity order; (b) an order requiring the Defendant to serve a response and (c) the listing of an interim relief application.
Following consideration of the documents lodged by the Claimant
ORDER by the Honourable Mr Justice Foxton
- Until further order:
a. Pursuant to CPR 39.2 there shall be substituted for all purposes in these proceedings including on the Court’s
Register of Claims and whether orally on in witing, in place of references the Claimant the letters “DYF”.
b. Pursuant to CPR 5.4C((4)(c), a person who is not party to these proceedings may obtain a copy of a statement of case, judgment or order from the court records only if it has been anonymised such that the Claimant is referred to in those documents only by the letters “DYF” and any reference to their names has been deleted from those documents.
c. Any person has liberty on three days’ written notice to the parties to apply to vary or discharge this paragraph. - The Secretary of State shall file a written response to the Claimant’s further medical evidence and the application for interim relief by 4pm on 12 November 2025.
- The application for interim relief shall be heard at an inter partes hearing as possible after the service of the Secretary of State’s response, with a time estimate of 2 hours.
Reasons
- The Claimant’s case raises personal details relating to his human rights and health and in these circumstances I am satisfied that anonymity is appropriate.
- Given the evidence as to the Claimant’s medical condition, I am satisfied that a measure of expedition is appropriate, but one which gives the Secretary of State a fair opportunity to prepare and given the volume of material which the Claimant’s legal team has produced.
