UPON the Court considering the N461, N463 and Statement of Facts and Grounds filed by the Claimant.

IT IS ORDERED:

Anonymity

  1. There be substituted for all purposes in this claim, in place of reference to the Claimant by name, and whether orally or in writing, reference to the letters “DZK”,
  2. The Court file is to be retained by the Court and marked ‘Anonymised’. Pursuant to CPR 5.4C, a person who is not a party to these proceedings may obtain a copy of pleadings, a Judgment or Order from the Court records only if the pleadings, Judgment or Order has been anonymised such that the Claimant is referred to as DZK in those documents and his address has been removed,
  3. Reporting restrictions apply as to the disclosing of any information that may lead to the subsequent identification of the Claimant. In particular, disclosure of the Claimant’s name or address is prohibited.

Directions

  1. The Defendant shall file and serve its response to this application for interim relief by 2pm on Monday 18 December 2023.
  2. Should either interested party wish to file and serve a response to this application for interim, that must be done by 2pm on Monday 18 December 2023.
  3. The Defendant shall make all reasonable endeavours to include in its response disclosure of the following documents:
    a. Copies of any correspondence between the Defendant and the First Interested Party from 20 September 2023 onwards.
    b. Copies of any correspondence between the Defendant and the Second Interested Party from 1 December 2023 onwards.
    c. Copies of any correspondence between the Defendant and medical or other professionals pertaining to the Claimant since 20 September 2023.
    d. Copies of any correspondence between the Defendant and West Yorkshire Integrated Care Board from 30 November 2023 onwards
    e. Copies of any notes kept by the social worker in connection with the assessment of the Claimant’s eligible needs from 20 September 2023 onwards.
  4. The matter shall be listed for an inter partes interim relief hearing at 14.00, time estimate 2 hours, on Tuesday, 19 December 2023, the matter to be joined with the interim relief hearing listed in case AC-2023-LON-002487.
  5. Costs reserved.

Observations

  1. The forthcoming hearing in London on 19 December 2023 is the reason why this matter is being listed for hearing in London rather than Leeds.
  2. The parties should be aware that, depending on the defendant’s stance as regards the application for interim relief, the Court on 19 December may not find itself in a position to deal with the matter that is already listed and this application, highly connected though they plainly are.
