UPON READING the Claimant’s application for urgent consideration of interim relief, and the papers filed by the Claimant;
AND UPON considering the Court file herein, including email correspondence from the Defendant;
IT IS HEREBY ORDERED THAT:
- The application for interim relief is adjourned to be determined at an oral hearing (“the Hearing”), on notice to the Defendant, to be fixed for Thursday 4 December 2025 with a time estimate of 2 hours 30 minutes.
- The Claimant’s application for anonymity is to be considered by the Judge at the Hearing. Until then, the Claimant is to be referred to in connection with these proceedings as ‘EDL’ and there must be no publication of the identity of the Claimant or of any matter likely to lead to the identity of the Claimant in connection with these proceedings.
- Liberty to apply to vary the terms of this Order on 24 hours’ notice to the other party and the Court;
- Costs reserved.
Observations
The Court would be assisted in this case by hearing oral submissions from both parties on the question of the interim relief sought by the Claimant by way of release from detention.
The Claimant also seeks derogations from open justice for reasons connected with his status as an asylum seeker. That application should be considered substantively at the hearing for which this order provides. Anonymity is ordered in the interim to preserve the Court’s ability to do so.
