BEFORE THE HONOURABLE MRS JUSTICE BRUNNER
UPON THE CLAIMANT’S APPLICATIONS (a) for anonymity; and (b) interim relief in the form of an order for the Claimant’s release from detention to accommodation provided by the Defendant
AND UPON hearing Ms Sonali Naik KC and Ms Grace Capel, counsel for the Claimant, and Ms Cathryn McGahey KC, counsel for the Defendant
IT IS HEREBY ORDERED THAT
- Pursuant to CPR 39.2(4) and/or the Court’s inherent jurisdiction and/or s. 6 of the Human Rights Act 1998: (a) the Claimant’s name shall be withheld from the public and must not be disclosed in any proceedings in public; and (b) the Claimant is to be referred to orally and in writing as EDL.
- Pursuant to s. 11 of the Contempt of Court Act 1981, there must be no publication of the identity of the Claimant or of any matter likely to lead to his identification in any report of, or otherwise in connection with, these proceedings.
- Unless the Court grants permission under CPR 5.4C(6), no non-party may obtain a copy of any unredacted statement of case. Should any non-party’s application for a copy of any statement of case be granted, the copy provided shall be one redacted by the parties to prevent identification of the Claimant.
- Any person wishing to vary or discharge paragraphs 1 –3 of this Order must make an application, served on each party.
- The application for interim relief against the Defendant is granted.
- The Defendant shall release the Claimant by 4pm on Monday 8 December 2025 to appropriate accommodation provided under s.98 or 95 of the Immigration and Asylum Act 1999.
- The parties have liberty to apply, on notice to the other party, to vary the terms of paragraph 6 above.
- Costs in the case.
AND IT IS DIRECTED THAT
- The Claimant is to file and serve a consolidated bundle by 4pm on 11 December
- The Defendant is to file her Summary Grounds of Defence by 18 December 2025.
- Thereafter the papers are to be placed before a single Judge for a decision on
permission on the papers.
