On an application by the Claimant for judicial review dated 15 April 2024

And upon the Defendant having decided on 19 April 2024 to withdraw the disqualification decision made in respect of the Claimant under s.63 of the Nationality and Borders Act 2022 dated 4 April 2024

BY CONSENT, IT IS ORDERED THAT

1. This application for judicial review is withdrawn.

2. The Defendant shall pay the Claimant’s reasonable costs of the judicial review claim, to be subject to a detailed assessment if not agreed.

3. There be a detailed assessment of the Claimant’s legally aided costs.

AND IT IS FURTHER ORDERED THAT

4. Pursuant to CPR r.39.2, in any report of these proceedings, there shall be no publication of the name and address of the Claimant, nor any other particulars likely to lead to her identification. In the proceedings, the Claimant shall be anonymized and referred to as “EO”.

Reasons

1. The Defendant has withdrawn the decision; the claim has become academic; it is right for it to be withdrawn; the agreed costs order is appropriate.

2. The Claimant is a victim of trafficking and sexual abuse, including rape. Balancing her interests in privacy against the strong public interest in open justice, the balance comes down in favour of
anonymity.
