Following consideration of the documents lodged by the Claimant

ORDER by Upper Tribunal Judge Elizabeth Cooke sitting as a Deputy High Court Judge

  1. Pursuant to rule 39.2 of the Civil Procedure Rules 1998, the identity of the Claimant shall not be disclosed directly or indirectly and this matter shall be known as R (EXC) v Secretary of State for the Home Department.
  2. The Claimant’s application for expedition is granted.
  3. The Defendant is to file and serve an Acknowledgment of Service and Summary Grounds of Defence within 14 days of the date of this Order.
  4. The Claimant is to file and serve any Reply within two working days of receipt of any Acknowledgment of Service and Summary Grounds of Defence.
  5. Thereafter the papers are to be placed before a Judge to consider whether permission and interim relief should be granted.
  6. Liberty to the parties to apply to set aside or vary this order on 48 hours’ notice to the other party.
  7. Costs reserved

Reasons

The matter is urgent because the claimant is destitute; however the Claimant very fairly acknowledges that the Secretary of State should have the opportunity to file an Acknowledgement of Service before interim relief is granted.
