On an application by the Claimant for urgent consideration and interim relief.

Following consideration of the documents lodged by the Claimant and the Defendant

ORDER by the Honourable Mr Justice Jay

    1. Pursuant to r. 39.2, the Claimant is anonymised as “FGH”. Nothing may be published which might lead to his identification.
    2. Until suitable accommodation has been identified for the Claimant by his offender manager, the Defendant must pay for the Claimant to stay at a hotel or hostel.
    3. Liberty to apply on 24 hours’ notice.
    4. Costs reserved.

    Reasons

    This is clearly a troubling case. I understand that it will take until 14 January 2026 for suitable accommodation to be approved by the Claimant’s offender manager. He is a sex offender and the need for this is obvious. In the meantime, the Claimant by his latest skeleton argument has advanced reasonably compelling arguments that the Defendant has power, converted in these circumstances into a duty, to pay for hostel or hotel accommodation.
    The cost is £35/day. The balance of convenience weighs in favour of the Order I am making. If the Defendant disagrees, the liberty to apply provision is available.
