Consent order

UPON considering the Claimant’s application for permission to apply for judicial review;

UPON the Claimant having been granted refugee status on Tuesday 17 September 2024;

UPON the Court having listed an interim application hearing on 24 October 2024;

IT IS ORDERED BY CONSENT THAT:

1. The Claimant do have permission to discontinue the proceedings pursuant to CPR 38.2;

2. Pursuant to CPR 39.2 the identity of the Claimant shall be withheld from the public and must not to be disclosed in any proceedings in open court or other publication.

3. The Claimant is anonymised as ‘FN. The claim shall be referred as R (FN) v the Secretary of State for Foreign, Commonwealth and Development Affairs.

4. The interim application hearing listed on 24 October 2024 is vacated.

5. The Defendant shall pay the Claimant’s reasonable costs of this claim, to be assessed if not agreed.

6. The Claimant’s publicly funded costs are to be subject to detailed assessment in accordance with the Civil Legal Aid (Costs) Regulations 2013.
