ORDER BY THE HON. MS JUSTICE NORTON
- Anonymity:
(a) Pursuant to CPR 39.2(4) and/or the Court’s inherent jurisdiction and/or s. 6 of the Human Rights Act 1998:
(i) the Claimant’s name is to be withheld from the public and must not be disclosed in any proceedings in public; and
Iii) the Claimant is to be referred to orally and in writing as FST.
(b) Pursuant to s. 11 of the Contempt of Court Act 1981, there must be no publication of the identity of the Claimant or of any matter likely to lead to the identification of the Claimant in any report of, or otherwise in connection with, these proceedings.
(c) Pursuant to CPR 5.4C(4):
(i) the parties must within 7 days file a redacted copy of any statement of case filed, omitting the name, address and any other information likely to lead to the identification of the Claimant;
(ii) if any statement of case subsequently filed includes information likely to lead to the identification of the Claimant, a redacted copy omitting that information must be filed at the same time;
(iii) unless the Court grants permission under CPR 5.4C(6), no non-party many obtain a copy of any unredacted statement of case.
(d) Any person wishing to vary or discharge this Order must make an application, served on each party.
- Prohibitory Injunction:
(a) The Defendant must not evict the Claimant from the accommodation provided to the Claimant at Flat 10 Alverna House, 480 Charminster Road, Bournemouth, Dorset BH8 9SH pending a determination on permission, or further order of the court;
(b) The Defendant may apply to vary or discharge paragraph 2(a) above, any such application to be served on the Claimant
THIS IS A PROHIBITORY INJUNCTION. BREACH MAY GIVE RISE TO PROCEEDINGS FOR CONTEMPT OF COURT. IT MUST BE COMPLIED WITH UNLESS AND UNTIL IT IS SET ASIDE BY A COURT, EVEN IF AN APPLICATION TO VARY OR DISCHARGE IT HAS BEEN MADE UNDER PARAGRAPH 2(b) ABOVE
3. Abridgement of time and expedition:
(a) The Defendant’s Acknowledgement of Service (CPR 54.8) must be filed and served by 4pm on 5 January 2026.
(b) Any Reply from the Claimant (CPR 54.8A) must be filed and served by 4pm on date 12 January 2026
(c) The papers are to be referred to a judge or deputy judge within 7 days thereafter.

REASONS
- Anonymity: The Claimant is an asylum seeker who has a conclusive grounds decision that they are a victim of trafficking. The Claimant alleges that she has been the victim of rape and sexual abuse. I am satisfied that these provide compelling reasons for the limited derogations from the principle of open justice in paragraph 1.
- Prohibitory injunction: The Claimant is currently housed with her 1year old son in a safe house. That accommodation has been provided in compliance with the Modern Slavery Victim Care Contract until 18 December 2025. The Claimant was informed that as an asylum seeker she should make a s.95 claim for asylum support. This application was made by her representatives on 28 November 2025, however the Defendant has failed to respond. At this stage, absent any response from the Defendant, on the face of the papers the Defendant appears to have acted unlawfully. Unless a mandatory injunction is made, the Claimant and her 1yr old child will be made street homeless, the balance of convenience is in favour of making an order for interim relief through a prohibitory injunction pending a determination on permission in this claim or further order of this court.
- Abridgement of time/expedition: There is an urgent need for the support and accommodation needs of the Claimant and child to be considered.
