UPON the Claimant being referred to the National Referral Mechanism as a potential victim of modern slavery on 8 June 2023, resulting in a negative reasonable grounds decision on 14 September 2023, and again on reconsideration on 15 January 2024 (the Challenged Decision).
AND UPON the Defendant agreeing to reconsider the Challenged Decision within one month of the date a sealed consent order is served, absent special circumstances.
BY CONSENT, it is ordered that:
1. The Claimant and her child are not to be identified and in these proceedings shall be referred to respectively as FXI and JXH. Pursuant to CPR 39.2 the identity of the Claimant and her daughter, and any particulars of the case likely to lead to their identification, shall not be disclosed directly or indirectly without the leave of the court.
2. The Claimant has leave to and will withdraw this application for permission to apply for judicial review.
3. The Defendant is to pay the Claimant’s reasonable costs, to be assessed if not agreed.
4. There be detailed assessment of the Claimant’s publicly funded costs.
