ORDER by His Honour Judge Keyser K.C. sitting as a Judge of the High Court
- The identity of the Claimant in these proceedings shall not be otherwise disclosed, but he shall be referred to as FZ.
- The requirement for the Claimant, as a putative minor, to conduct these proceedings by a litigation friend is dispensed with.
- The application for permission to apply for judicial review is granted.
- The claim is transferred to the Upper Tribunal (Immigration and Asylum Chamber) for directions and determination thereafter, with a request that the hearing of the claim be expedited.
Observations
The claim appears properly arguable and there ought to be an age assessment by the Upper Tribunal. Anonymity is justified by reason of the Claimant’s claimed age. However, in the circumstances it is just and reasonable to dispense with the need for a litigation friend. As this Order is being made nearly 4 months after the Claimant applied for expedition, it is hoped that the Upper Tribunal will be able to hear the claim reasonably quickly.
