- Interim relief: The application for immediate interim relief is refused. However, the application for interim relief is to be reconsidered in accordance with para. 2 below.
- Abridgement of time and expedition:
(a) The Defendant’s Acknowledgement of Service (CPR 54.8) must be filed and served by 4pm on 29 January 2026.
(b) Any Reply from the Claimant (CPR 54.8A), together with any response to the Defendant’s submissions on interim relief, must be filed and served by 4pm on 2 February 2026.
(c) The papers are to be referred to a judge or deputy judge immediately thereafter for a decision on (i) permission to apply for judicial review and (ii) interim relief.
Reasons
(1) The Claimant says that she and her disabled son are homeless. However, she does not say that they are street homeless, just that they do not have “settled accommodation”. In the circumstances, it is not appropriate to grant interim relief without affording the Defendant an opportunity to make submissions.
(2) The timetable set in these directions strikes the appropriate balance between the interests of the parties.
