Notification of the Judge’s decision on the application for permission to apply for judicial review (CPR 54.11, 54.12) and the Defedant’s Acknowledgment of Service

Following consideration of the documents lodged by the Claimant

ORDER by Margaret Obi (sitting as a Deputy High Court Judge)

Anonymity and Litigation Friend

1. The Claimant’s mother shall be appointed as her litigation friend.

2. The Claimant’s application for an anonymity order is granted under CPR r 39.2(4) and the general case management powers in CPR r. 3.1(2). The Claimant in this case shall have anonymity until further order. No report or publication of these proceedings shall directly or indirectly identify the Claimant and his dependant family members. The matter shall be referred to as R (GM, through her mother and litigation friend – CM) v Surrey County Council.

3. Pursuant to CPR r.5.4C, a person not a party to the proceedings may obtain a copy of the statement of case, judgment or order of the court records, only if the statement of case, judgment or order from the court has been anonymised. Failure to comply with this direction could lead to contempt of Court proceedings.

Consent Order

4. The draft consent order signed and dated on 25 April 2024 is approved.

BY CONSENT IT IS ORDERED THAT

1. These proceedings are stayed until 3 June 2024 to enable the parties to explore resolution.

2. If resolution is reached the parties shall file a Consent Order to this effect duly signed by each party;

3. If the parties are unable to reach resolution the Claimant must advise the court before 4pm on Friday the 31 May of their position and confirm what further directions are sought.
