Order

On an application by the Claimant for an anonymity order.

AND UPON the Court finding that on the information provided an anonymity order is necessary to secure the proper administration of justice and to protect the interests of the Claimant’s daughter who is a child, and that an exceptional derogation from the principles of open justice is justified on this basis.

Pursuant to rules 39.2(4), 5.4C of the Civil Procedure Rules, section 39 of the Children and Young Person Act 1933, and Section 11 of the Contempt of Court Act 1981.

ORDER BY Deputy High Court Judge Clare Padley on 18 February 2025:

1. Until further order:
a. the Claimant’s identity and that of her daughter shall be anonymised and shall not be directly or indirectly disclosed. These proceedings shall be known as “R(GMT) v London Borough of Lambeth”
b. References to the Claimant by name, whether orally or in writing shall be substituted by “GMT”
c. References to the Claimant’s daughter whether orally or in writing, shall be substituted by “FMT”

2. Pursuant to s.11 Contempt of Court Act 1981, there must be no publication of the identity of the claimant or her daughter or of any matter likely to lead to the identification of the claimant or her daughter in any report of, or otherwise in connection with, these proceedings.136

3. Pursuant to CPR 5.4C(4):
(a) The parties must, when filing any statement of case, also file a redacted copy of that statement of case omitting the name, address and any other information which could lead to the identification of the claimant.
(b) Unless the Court grants permission under CPR 5.4(C) (6), no non-party may obtain an unredacted copy of any statement of case.

4. The Defendant or any non-party affected by this anonymity order may apply for an order setting aside, varying or discharging this order, provided that such application is made on 3 days’ notice to the Claimant.

5. Pursuant to CPR 39.2(5) and the Practice Guidance: Publication of Privacy and Anonymity Orders dated 16 April 2019 a copy of this order shall be published on the Judicial Website of the High Court of Justice (www.judiciary.uk). For that purpose, a court officer will send a copy of the order by email to judicialwebupdates@ejudiciary.uk

6. The costs of obtaining this order shall be costs in the case
