Following consideration of a non-urgent application and of the documents lodged by the Claimant
ORDER by His Honour Judge Auerbach (sitting as a Judge of the High Court)

  1. The Claimant’s application for abridgment of time is refused.
  2. The Claimant is anonymised in these proceedings as HA, and her five children (oldest to youngest) should be referred to as PA, QA, RA, SA and TA, subject to further order. There shall be no publication of the names of any of them or of information that might lead to any of them being identified.
  3. The Claimant’s application for abridgment of time is refused.

Reasons

  1. This application for judicial review includes a non-urgent application for abridgment of time for the acknowledgment of service. The reasons for this application are set out in the SFG and there is also an email of 7 July 2023.
  2. I appreciate that there is a longstanding background of allegations of domestic abuse, and what is said to be the increased level of concern on account of the Claimant’s husband having discovered her current location a few weeks ago. However, I do not think that this warrants the short abridgment of time for an acknowledgment of service being sought by this non-urgent application. I have therefore refused that application.
  3. Having regard to those allegations, the ages of the five children, issues of disability, and the evidence of a previous anonymity order, I have made an anonymity order, extending also the children, at this stage.
  4. The question of permission will fall to be considered once the time for an Acknowledgement of Service has expired.
