On an application by the Claimant for urgent consideration, interim relief and directions
Following consideration of the documents lodged by the Claimant:
ORDER by the Hon. Mrs Justice Collins Rice:
- The Defendant is to file and serve a response to the application for interim relief and anonymity by 10am on Monday 28th October 2024.
- The papers are to be referred to a judge or deputy judge for a decision whether to grant interim relief and anonymity immediately thereafter.
- Until further order of the Court pursuant to paragraph 2 above:
(a) the Defendant is to ensure that the Claimant continue to receive trafficking support under her National Referral Mechanism;
(b) the Claimant’s name is to be withheld from the public in connection with these proceedings and is to be referred to instead as “IK”; there must be no publication of the identity of the Claimant or of any matter likely to lead to the identification of the Claimant in any report of, or otherwise in connection with, these proceedings. - Liberty to the Defendant apply for the variation or discharge of this Order.
Observations
The Claimant’s evidence is that he is at least at acute risk of being made streethomeless pursuant to the decision under challenge at noon on Monday 28th October He says that will be the direct result of the withdrawal of trafficking support. (There appears to be some administrative confusion about the precise details of his hotel booking, however.)
The Court would be assisted by the Defendant’s perspective. Her letter of response of yesterday’s date does not appear to address the issue of interim relief. This order makes provision accordingly, and for the matter to be considered urgently thereafter.
Brief interim provision is made in order to permit the applications for interim relief pending resolution of JR proceedings, and for anonymity, to be considered on their merits according to this timetable by ‘holding the ring’ meanwhile.
