Order

On an application by the Claimant for urgent interim relief
Following consideration of the documents lodged by the Claimant
ORDER by the Honourable Mr Justice Morris

  1. For the purposes of these proceedings the Claimant shall be referred to as IS (Bangladesh).
  2. No person shall disclose or publish any document relating to these proceedings in such a manner as to identify the Claimant either directly or indirectly.
  3. The Claimant’s application for interim relief/High Court bail shall be listed for an oral hearing on Friday 1 December 2023, with a time estimate of 2 hours
  4. The Defendant shall file and serve a statement setting out his position on the application for interim relief/High Court bail by 10am on Thursday 30 November 2023.
  5. The parties shall have liberty to apply on 24 hours’ notice to each other.
  6. Further directions to be set on the determination of the application for interim relief.

Reasons

  1. I am satisfied that there is sufficient urgency for the question of the Claimant’s release from immigration detention should be considered promptly at an inter partes hearing.
  2. At that hearing, the Claimant intends to seek an order for interim relief in the following terms:
    “By [72 hours after the end of the hearing], the Claimant shall be released on bail to a suitable address on terms to be set, with liberty to apply.”
