Following consideration of the documents lodged by the Claimant and the Acknowledgement of Service filed by the Defendant

Order by the Honourable Mr Justice Jay

1. The application for permission to apply for judicial review is refused.
2. Anonymity granted pursuant to CPR r. 39.2. The Claimant must be referred to solely as JB and his litigation friend as GD. Nothing may be published which may lead to his identity being revealed.
3. GD is appointed as the litigation friend of JB.
4. No order as to costs.

Reasons

The advisory note, before it was superseded, contained an arguable legal flaw. That note has now been replaced by advice which is lawful: see the revised note dated 11th March 2022. The Claimant appears to accept that this disposes of Ground A, but in my view it also disposes of Ground B.
In the circumstances, I have decided to make no order as to costs.
