ORDER by Upper Tribunal Judge Elizabeth Cooke sitting as a Deputy High Court Judge
IT IS ORDERED THAT:
- Pursuant to CPR r.39.2, the identity of the Claimant shall not be directly or indirectly disclosed. These proceedings shall be known as ‘R(JO by his father and litigation friend, OJ) v Bromley Council.
- OJ is appointed as the Claimant’s litigation friend.
- The claim is suitable for a substantial degree of expedition.
- The Defendant’s Acknowledgement of Service (CPR 54.8) must be filed and served by 4pm on 3 January 2025.
- Any Reply from the Claimant (CPR 54.8A) must be filed and served by 4pm on 10 January 2025.
- The papers are to be referred to a judge for a decision on the permission application and for consideration of whether there should be a rolled-up hearing as soon as possible thereafter.
- The parties shall have liberty to apply to vary or set aside this order on two working days’ notice to the other parties.
- Costs reserved
Reasons
Expedition is clearly appropriate in the circumstances, and the Defendant is on notice of the claim.
