Order

UPON the Order of Mr Justice Goose dated 25 March 2024 (the “Order”)

AND UPON the Claimant’s application dated 25 March 2024 (the “Ex-Parte Application”);

AND UPON the Claimant’s application of 5 April 2024 seeking that the Order be continued until trial or further order of the Court, and restoring the Claimant’s application as sought in paragraphs 4, 5(b) and 6-7 of the draft order filed with the Claimant’s Ex-Parte Application pursuant to paragraph 17 of the Order;

AND UPON hearing from counsel for the Claimant, and the Defendant not appearing in Court, at the return date of the Ex-Parte Application on 10 April 2024

AND UPON the Court reading the emails from the Defendant sent to the Court at 19:13 on 8 April 2024 and 00:59 on 10 April 2025

IT IS ORDERED THAT:

Injunction

1. The Order of Mr Justice Goose dated 25 March 2024 shall continue until trial or further order of the Court.

Anonymity

2. Pursuant to section 6 HRA, and/or CPR 39.2 the Judge, being satisfied that it is strictly necessary, ordered that:
(a) the individual identified in the Confidential Schedule to this Order shall be referred to for all purposes in these proceedings, whether orally or in writing, by the letters “AA”; and
(b) there be substituted for all purposes in these proceedings in place of references to the individual identified in the Confidential Schedule to this order by name references to the letters “AA”.

3. Until the return date or further Order of the Court, the Defendant must not publish any information which is liable to or might identify AA as the subject of the Information or which otherwise contains material which is liable to, or might lead to AA’s identification in any such respect, provided that nothing in this Order shall prevent the publication, disclosure or communication of any information which is contained in this Order other than in the Confidential Schedule, or in the public judgments of the Court in this action.

Information to be disclosed

4. The Defendant shall within 24 hours of service of this Order disclose to the Claimant’s solicitors the following:
(a) the identity of each and every third party to whom the Defendant has disclosed all or any part of the Information since 14 March 2024; and
(b) the date upon which such disclosure took place and the nature of the information disclosed.

5. The Defendant shall confirm the information to be supplied in accordance with paragraph 4 above in a witness statement containing a statement of truth within 7 days of complying with paragraph 4 and shall serve the same on the Claimant’s solicitors.

Service

6. The Claimant has effected good service on the Defendant in compliance with paragraphs 3 and 4 of Schedule B to the Order of 25 March 2024 by serving the relevant documents by email to yonner79@googlemail.com on 2 April 2024 and 26 March 2024 (respectively).

7. The Claimant has permission to serve documents on the Defendant in these proceedings by email to yonner79@googlemail.com.

Costs

8. The costs of and occasioned by the Application are reserved.
